ONYX Club

1. General

The ONYX Club website, available at www.onyxclub.ai (the "Website"), is operated by the Operator ("the Operator").

These Terms of Use constitute a legally binding agreement between you, whether as an individual or on behalf of an entity ("the User"), and the Operator, governing your access to and use of the Website and its services.

Use of the Website is permitted to individuals aged 18 years or older only. By accessing or using the Website, you represent and warrant that you meet this requirement.

The Operator reserves the right to amend these Terms at any time, at its sole discretion. Amendments shall become effective upon publication on the Website.

2. Services

The Website provides an online dating platform allowing Users to create personal profiles and communicate with other Users.

Certain features and services are available only through a paid subscription. The Website may also include articles, blogs, forums, and additional content.

3. User Accounts and Content

The User is solely responsible for the accuracy, legality, and content of all information and materials uploaded or shared through the Website.

  • Unlawful, abusive, misleading, infringing, or offensive content is strictly prohibited.

  • Commercial, advertising, or marketing content is prohibited without prior written approval from the Operator.

  • Impersonation or submission of false information is prohibited.

The Operator may remove content, suspend or terminate accounts at its sole discretion, without prior notice.

4. Sharing of Contact Information

The Website allows Users to voluntarily share personal contact details with other Users, including phone numbers, email addresses, and messaging applications.

Any such sharing is done at the User's sole responsibility and by the User's free choice.

The Operator is not a party to any communication, interaction, or relationship that occurs outside the Website and bears no liability for any harm, misuse, harassment, or privacy violation resulting therefrom.

Use of other Users' contact information for commercial, promotional, marketing, or solicitation purposes is strictly prohibited.

5. Class Action Waiver and Limitation of Remedies

5.1 Class Action Waiver

To the fullest extent permitted by law, the User agrees that any dispute, claim, or cause of action arising out of or relating to the use of the Website shall be resolved on an individual basis only, and not as a class, collective, representative, or class action.

5.2 Limitation of Liability

To the extent permitted by law, the Operator's total liability for any claim shall not exceed the amount actually paid by the User to the Operator during the twelve (12) months preceding the event giving rise to the claim, if any.

5.3 No Reliance

The User acknowledges that no representations or warranties have been made other than those expressly stated in these Terms, and that use of the Website is at the User's own risk.

6. Disclaimer

The Website and services are provided on an "AS IS" and "AS AVAILABLE" basis. The Operator makes no warranties regarding availability, reliability, or outcomes resulting from use of the Website.

7. Termination

The Operator may suspend or terminate access to the Website, in whole or in part, at any time, for any reason, with or without notice.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Israel. Exclusive jurisdiction shall lie with the competent courts of the Tel Aviv District.

9. Acceptable Use Policy

Users agree NOT to:

  • Use the platform for illegal activities
  • Harass, threaten, or intimidate other users
  • Create fake profiles or misrepresent identity
  • Share content involving minors in any context
  • Engage in commercial solicitation without authorization
  • Attempt to circumvent security measures
  • Scrape or collect user data
  • Upload malware or malicious code

10. Intellectual Property

All content on Onyx Club, including text, graphics, logos, and software, is the property of Onyx Club or its licensors and is protected by intellectual property laws. Users retain ownership of content they create but grant Onyx Club a license to use, display, and distribute such content within the platform.

11. Dispute Resolution

11.1 Informal Resolution

Before filing any formal proceedings, parties agree to attempt informal resolution by contacting [email protected].

11.2 Binding Arbitration

If informal resolution fails, disputes shall be resolved through binding arbitration under the rules of the agreed arbitration body, except for claims that qualify for small claims court.
